All Counts of Rape, Sexual Assault Dismissed Against Former Non-Profit Director

Daniel Malcolm Stallard, former director of Operation Adopt a Hero, appeared in Rutherford County Circuit Court on Monday, August 21, 2017, with counsel, Scott Kimberly, and entered a No Contest Plea to Extortion under Judicial Diversion, which allows Stallard to expunge the conditional conviction from his record after a period of two years.

Stallard was charged with eight counts of rape, two counts of sexual battery, and one count of extortion, arising from allegations that he sexually assaulted a woman who arrived at Operation Adopt a Hero to perform court-ordered community service.

Pursuant to the plea agreement, Stallard pleaded No Contest, a plea in which the Defendant is found guilty but does not admit the truth of the underlying allegations, to extortion and entered the plea pursuant to Judicial Diversion, which allows a Defendant to erase and expunge all records related to the conviction after the successful completion of the probation term.

Stallard agreed to perform one hundred hours of community service work, to not obtain employment that has supervisory capacities over court-ordered community service, and to refrain from performing community service alone with females.

Stallard will be released from incarceration on Monday, August 21, 2017, and no further jail time will be required under the plea agreement.
