Appeal case falls short for man with felony amount of cocaine in Rutherford County

A man who plead guilty before Rutherford County Judge David Bragg for felony possession of cocaine in 2005 asked the Court of Criminal Appeals to reconsider a 2013 case when he violated his probation. The case was officially denied by the Tennessee Supreme Court this month.

According to the sentence in the original cocaine case, James Cauley was ordered to serve nine years on probation. However, when he was re-arrested in 2013, the probation was out the window and Cauley was eventually ordered to serve the remainder of his probation behind bars. He later argued in 2014 that he should receive credit for time already served.

Regardless of the argument, the courts did not see it the same way Cauley saw it and he was ordered to remain in prison. The appeal, that was filed in 2015 affirmed the opinion of the trial court. In other words, Cauley will remain in prison until he is 40. He is 35 today.

Again, the case was officially denied this month (September 2015).
