Child rapist in Murfreesboro denied a new trial by the Tennessee Supreme Court

A man indicted by a Rutherford County Grand Jury for raping a child and then later convicted has been denied a new trial.

David Neal Davis was convicted for the rape of a child, attempted rape of a child, seven counts of aggravated sexual battery, two counts of child abuse, and one count of attempted solicitation of a minor in Rutherford County. Soon after the conviction, he filed an appeal in the Court of Criminal Appeals.

Davis suggested he had ineffective assistance of counsel during his trial. Davis received a 20-year sentence and later insisted that his case was not adequately investigated.

The courts disagreed with the petitioner and Davis will remain behind bars. After the court of Criminal Appeals decided to deny Davis another trial, the Tennessee Supreme Court filed a second denial. The second order was released by the courts earlier this week (9/2/14).

The 69-year old man is listed as a "Violent" sex offender. He is housed in a West Tennessee prison at this time. His last Murfreesboro address was on Moccasin Trail in the Riverview Subdivision.
