COFFEE COUNTY: Car Dealer Vs. Bank in Court

A former Tullahoma businessman is facing serving several years in federal prison after being found guilty of bank fraud in federal court last week. According to court documents, Randy Roberts, the former owner of the AutoSmart car sales in Tullahoma and Cookeville was found guilty of seven of the 41 counts of bank fraud.

The conviction came after testimony by several witnesses including a former bookkeeper of the company. Linda Sue Green, who was the bookkeeper for Roberts, testified in U.S. District Court in Chattanooga that Roberts devised a scheme where he purchased vehicles with money loaned to him by Lincoln County Bank. Federal prosecutors alleged that when officials of Lincoln County Bank visited his business and checked the inventory, they were told that the vehicles were either being test driven, repaired or cleaned when in fact Roberts had sold the vehicles.

Testimony during the trial indicated that the Bank of Lincoln County lost some $400,000 as the result of the scheme. Roberts faces a maximum of 30 years in federal custody on each of the seven counts, but he is not expected to receive that severe of a sentence. -WMSR News

    I know the Roberts’s family. Randy has always helped the community, schools, and needy. He is a very honest man, and very respected in the automotive community.This has been very hard on his family and I am glad it is over for them.

    Ten months after trial and 5 postponed sentencing dates by the court, July 1, 2010, Judge Mattice ruled on this case. Randy Roberts received 1 day time served, and probation. He owed $0 to the Bank of Lincoln County.

    After much research, the court found that the Bank of Lincoln County did not credit $500,000 to Mr. Roberts from the sell of the Celebration Nission Building. Randy Roberts did not owe any money to the bank. The court declared no loss to the Bank of Lincoln County.

    During the sentencing, the court directed the US Attorney’s office and FBI to investigate the Bank of Lincoln County and Jeff Whitmore for a transaction that came to light during the proceedings in this case. This had nothing to do with Mr. Roberts, so the Judge asked for meeting in his chambers later to proceed with this investigation.
