Man charged with DUI 3 after being found passed out in car

A man who appeared to be passed out in a car parked at the Jackson Heights Plaza in Murfreesboro ended up going to jail on Sunday morning. 34-Year old Argel Nogales-Escobar was said to be sitting in his Nissan parked outside of 810 NW Broad Street at about 1:30 in the morning on Sunday with the car still running.

When Officer Rodriguez got closer to the car he noticed an open container of beer. The officer unsuccessfully tried to wake the sleeping man, but had little luck tapping on the window. Upon opening the door, Nogales-Escobar awoke from his slumber and attempted to drive away, according to an arrest report.

Police physically removed the subject from his car and took control of the man, later asking him to perform a field sobriety test which he refused. It was later found that Nogales-Escobar had two prior DUI's in years 2002 and 2010.

The suspect, who told police he did not have an occupation or employer, was charged with his 3rd DUI, resisting arrest and violation of the open container law. He will appear in court on November 4, 2014.
