Rutherford County Sex Offender Appeals the Courts

A registered Sex Offender in Rutherford County challenged the courts suggesting that him being tracked was unconstitutional.

Milvern Hoss, Jr. was found guilty most recently for violating the sex offender requirements due to his failure to report monthly. After he failed to report, he was sentenced to serve a total of four years behind bars.

Ironically, Hoss was not convicted of a sexual in nature crime while in Tennessee. He was convicted on an aggravated sexual battery charge in the state of Kansas in 1992. He was then released from prison in Kansas in 1997 eventually making the move to Rutherford County, TN.

In 2010, Hoss was arrested for public intoxication while in the Murfreesboro area. While jailed, he signed the required sex offender paperwork for the Volunteer State. However, he failed to follow the reporting requirements.

Hoss appealed citing the verification of his whereabouts was illegal in its application to him. He also suggested the courts lacked sufficient evidence to sustain his conviction.

The Appeals Courts in Tennessee did not agree with Hoss and he will have to remain behind bars for not following the Sex Offender Registry rules.
