Appeals Court Tells Rutherford County Mom She Can Not Have Child Back

The mother of a child who lost the custody of her son in Judge Donna Scott Davenport’s Rutherford County courtroom has filed an appeal with the courts in nearby Nashville seeking to regain custody of the child. Court documents show the child was taken away from the unnamed mother in 2011 because drugs were being manufactured in the mothers’ home and DCS confirmed that illegal activity was taking place. The mother however contends that evidence does not clearly show that termination of parental rights is in the child’s best interest. The courts not only disagreed in 2011 and 2012, they also disagreed this past week.

Court records from 2012 state, “With respect to Mother the petition asserted as grounds of severe abuse of the child.”

On April 17th (2013)  Judge Richard H. Dinkins wrote in regards to the Rutherford County child, “The evidence clearly and convincingly shows that termination of Mother’s parental rights was in the best interest of (the child).”
