Can a City Legally Insist Pharmacies Sell Pseudoephedrine to Customers With a Prescription Only

Two weeks ago WGNS told you about several mid-state cities changing their city ordinances and requiring pharmacies to only sell medications containing pseudoephedrine to those who have a prescription from their doctor. One of the cities we told you about was nearby Manchester. That city is now rethinking the idea.

An ordinance that would have banned over-the-counter sales of medicine containing pseudoephedrine in hopes of curbing methamphetamine production in the Manchester City Limits was tabled by the Manchester Board of Mayor and Aldermen at its meeting this past week. The reason was due to the question of whether or not the city has the legal authority to enact such a ban and force anyone looking for decongestants such as Sudafed to obtain a prescription appears suspect.

Board members noted that they took the action based on advice of the city attorney. Other cities such as Winchester have already voted in ordinances to ban the selling of the drug.
