Convicted Sex Offender in Rutherford County sees his Probation Revoked

A man by the name of Kenneth Leigh McPeak appealed his probation revocation in Rutherford County. McPeak was originally charged with two counts of rape in 2012, but later plead guilty to two counts of attempted rape in 2013 in the Rutherford County courtroom of Judge David Bragg. The convict was sentenced to serve 16-years behind bars, but after the first year of confinement, he would be allowed to serve the next 15 years under supervised probation.

In 2014, McPeak told his probation officer he applied for about 10-jobs, but failed to show proof that he actually sought employment. He also failed to arrive for a polygraph examination and failed to attend court ordered sex offender treatment classes. McPeak claims he skipped the polygraph because he lacked $175 to pay for it. The probation officer testified that although the polygraph test costs money, people on probation are not typically dismissed from the program due to non-payment. As a result of the local sex offender violating his probation requirements, his probation was revoked in December of 2014.

To make matters worse for McPeak, the defendants' sexual treatment provider wrote in a letter to the state, "[The defendant] denies his offense of conviction and assumes no responsibility for his criminal sexual behavior. He blames the victim and his attorney for his current legal status."

Kenneth McPeak will remain behind bars as the courts ruled that his revocation of probation was just and accurate. He is currently housed at the Bledsoe County Correctional Complex where is sentence is scheduled to end in year 2028 shortly after McPeak turns 73. He will again be eligible in year 2018.
