Driver Charged with Vehicular Homicide by Intoxication for Death of Unborn Child

A Middle Tennessee case where vehicular homicide charges have been filed because of the death of an unborn child is making headlines nationwide.

Jose Marquez Lopez, 21, was arrested Wednesday (10/28/15) on a multi-count grand jury indictment charging him with killing an unborn baby in a two-vehicle collision in the 3900 block of Apache Trail on Christmas day 2014. The accident occurred in Nashville, TN.

Lopez, of Packard Drive in Nashville, is charged with vehicular homicide by intoxication, three counts of reckless endangerment, and two counts of vehicular assault.

The investigation by the fatal crash team shows that Lopez was driving a 2003 Honda CRV north on Apache Trail when he crossed over the double-yellow line at 4:45 p.m. and collided head-on with a 2008 Dodge Avenger. The driver, Brittany Montanez, was 17 weeks pregnant at the time of the crash. Montanez, 26, and her front seat passenger, Ladonna Rivers, 25, were transported to Vanderbilt University Medical Center with non-life threatening injuries. Montanez' unborn child died the next day.

Lopez is being held in lieu of $100,000 bond.
