A 57-year old man convicted during a Rutherford County trial before Judge Keith Siskin says that the City of LaVergne did not have the jurisdiction to even investigate his case.

Smyrna resident Roy Allen Smith who was convicted on numerous drug charges, was sentenced to 12-years in prison soon after the LaVergne Police Department seized several hundred pain pills at his home in 2012. Once in court, Smith's attorney raised the issue surrounding the problem of the home being outside the city limits of LaVergne, but still in Rutherford County.

The so called problem of jurisdiction was not deemed an issue in the original courtroom of Keith Siskin. According to the most recent filling in the Appeals Court of Tennessee, Judge John Everett William of Nashville took a second look at the issue of the LaVergne Police Department exceeding their jurisdiction. Judge William agreed with Judge Siskin, therefore the appeal was denied and Smith will remain behind bars on multiple drug related convictions.

Note: Also involved in the original 2012 case were the Rutherford County Sheriff's Office and the National Guard Counter Drug Task Force
