Murfreesboro mother convicted of child rape X6 files an appeal

A woman who was convicted for raping her son in Rutherford County between 1999 and 2003 has asked for a new trial.

Angela Montgomery who reportedly moved away from the Murfreesboro area several years after the accusations arose, was arrested in Portland, Oregon in 2012. The case was investigated by Murfreesboro Police over an 8 month period several years after the child rape incidents occurred.

In 2015, Montgomery was found guilty on six counts of child rape. At the time of the crime, the child would have been between the ages 9 and 13. The now adult victim told the courts the abuse also happened to his sister and brother.

In Montgomery's most recent request for a new trial that was filed with the Tennessee Court of Criminal Appeals, she argues that there was not enough evidence to support her convictions of child rape. She also argued that the State should not have presented information to the jury about her alleged corporal punishment habits that involved her kids.

Despite Montgomery's arguments and plea for a new trial, it won't happen. Montgomery will remain behind bars for her six child rape convictions. The denial for an appeal was officially filed on Friday, September 1, 2017.

Today Montgomery is 55 years old. At the time of the crime she would have been about 38 years old and her son was 9. Her prison sentence will end in year 2054. At that point, Montgomery will be 92 years of age. According to the Tennessee Department of Corrections, Montgomery is not eligible for parole.
