Murfreesboro Police Affirm Officer Had to Use Additional Force to Arrest Intoxicated Subject Thursday Morning (With YouTube Video)

A Murfreesboro Police Officer had to use “hand strikes” and “knee strikes” in order to make a disorderly suspect comply, prior to being placed in handcuffs on Thursday morning. The incident occurred at a bar on Old Fort Parkway as Officer Kenneth White was conducting a “bar check.”

According to Sgt. Kyle Evans, Officer White witnessed a man identified as Jerry Mosley pull his pants down exposing his rear end to bar patrons. Officer White suggested to Mosley that he should seek a ride home because he appeared to be heavily intoxicated. The officer reported the suspect began to cause a disturbance and that was when he moved in to make an arrest. According to an arrest report, Mosley is a Smyrna Fire Fighter.

Sgt. Evans stated, “Officer White attempted to place Mr. Mosley under arrest for Public Intoxication and Indecent Exposure when Mosley began to actively resist the lawful arrest by swinging his arms and refusing to be handcuffed. Officer White then put Mr. Mosley on the ground in order to gain compliance and control.”

“When verbal commands and soft empty-hand control efforts were unsuccessful, Officer White applied a series of knee strikes and a series of hand strikes to Mosley’s torso in an effort to gain compliance. After the use of force was applied, Mr. Mosley surrendered his arm as originally instructed, was handcuffed, transported to the Rutherford County Sheriff’s Office and booked on the charges of Public Intoxication, Indecent Exposure, and Resisting Arrest.”

Mosley was taken to jail where he was able to bond out early Thursday morning.

Just after midnight this morning, Officer Kenneth White, a member of the Murfreesboro Police Department Alcohol Countermeasures Team (MPACT), was conducting a bar check at 1720 Old Fort Parkway when he observed an individual who appeared to be heavily intoxicated. Officer White reported that he observed the male subject, later identified as Jerry Mosley, pull his pants down and expose his rear end to the other patrons of the business.

Officer White approached Mr. Mosley in the outdoor patio area and told him to leave and advised him to call a taxi. Instead of leaving, Mr. Mosley then began to curse loudly and draw attention to himself. Officer White attempted to place Mr. Mosley under arrest for Public Intoxication and Indecent Exposure when Mosley began to actively resist the lawful arrest by swinging his arms and refusing to be handcuffed. Officer White then put Mr. Mosley on the ground in order to gain compliance and control. The resistance continued and Mr. Mosley refused to comply with the officer’s repeated verbal commands to stop resisting the arrest. Officer White also made several attempts to physically remove Mosley’s arm from underneath his body for handcuffing.

When verbal commands and soft empty-hand control efforts were unsuccessful, Officer White applied a series of knee strikes and a series of hand strikes to Mosley’s torso in an effort to gain compliance. After the use of force was applied, Mr. Mosley surrendered his arm as originally instructed, was handcuffed, transported to the Rutherford County Sheriff’s Office and booked on the charges of Public Intoxication, Indecent Exposure, and Resisting Arrest.

After reviewing the video and statements from the officers involved, Department officials believe the level of force applied is reasonable and appropriate, consistent with the level of resistance offered by Mr. Mosley and is also consistent with training, department policy, and state law.

Officer White is an eleven year veteran of MPD and has received numerous commendations throughout his career including Mothers Against Drunk Driving (MADD) Officer of the Year Award in 2012.
