UPDATE: Murreesboro Police Bust Man Who Allegedly Convinced Teen at Local Swimming Pool to Go Home With Him

WGNS has more news on the arrest of a 32-year old man believed to have been involved in an inappropriate sexual relationship with a 14-year old girl in Murfreesboro. The relationship started earlier in the month when Daniel Barrow reportedly met the victim at a local swimming pool on Labor Day.  A police report filed by Detective Tommy Roberts shows that Barrow convinced the child to leave the pool and go with him to his Haynes Manor Apartment. It was at that apartment where the two were said to have engaged in sexual activity.

After a number of days passed, Barrow again arraigned for the 14-year old to once again meet with him at his apartment to allegedly have sex, according to an MPD Arrest Report. After making the arraignments, Barrow was likely surprised when police showed up at his door instead of the child on September the 16th.

Barrow, who works in an area factory, was taken to the police department to be interviewed where he was officially arrested and charged with aggravated statutory rape. The suspect was placed under a $10,000 and is scheduled to appear in court on October 31, 2013. The report states, “Other charges are possible.” As of Friday, Barrow was still behind bars at 12 (noon).

9-13-506.  Statutory rape. 

  (a) Mitigated statutory rape is the unlawful sexual penetration of a victim by the defendant, or of the defendant by the victim when the victim is at least fifteen (15) but less than eighteen (18) years of age and the defendant is at least four (4) but not more than five (5) years older than the victim.

(b) Statutory rape is the unlawful sexual penetration of a victim by the defendant or of the defendant by the victim when:

   (1) The victim is at least thirteen (13) but less than fifteen (15) years of age and the defendant is at least four (4) years but less than ten (10) years older than the victim; or

   (2) The victim is at least fifteen (15) but less than eighteen (18) years of age and the defendant is more than five (5) but less than ten (10) years older than the victim.

(c) Aggravated statutory rape is the unlawful sexual penetration of a victim by the defendant, or of the defendant by the victim when the victim is at least thirteen (13) but less than eighteen (18) years of age and the defendant is at least ten (10) years older than the victim.

(d)  (1) Mitigated statutory rape is a Class E felony.

   (2)  (A) Statutory rape is a Class E felony.

      (B) In addition to the punishment provided for a person who commits statutory rape for the first time, the trial judge may order, after taking into account the facts and circumstances surrounding the offense, including the offense for which the person was originally charged and whether the conviction was the result of a plea bargain agreement, that the person be required to register as a sexual offender pursuant to title 40, chapter 39, part 2.

   (3) Aggravated statutory rape is a Class D felony.
