The issue of the Islamic Center of Murfreesboro building a new mosque in Rutherford County is now before the Court of Appeals in Nashville. The state court will have to make the decision if the county gave proper public notice prior to approving construction. A group of local citizens are fighting the mosque, even though it is already open, suggesting that is should not have been built because of the lack of public notice.
Groundbreaking for the mosque on Veals Road at Bradyville Pike took place in 2011 and the first phase of the mosque was completed in 2012. The mosque later opened after receiving their occupancy permit from Rutherford County.
In May of 2012, Chancellor Robert Corlew ruled construction of the Islamic Center must be halted because local officials did not give adequate public notice. The federal government later stepped in to ensure that the local group could complete construction and occupy the facility. U. S. District Chief Judge Todd Campbell later issued a temporary restraining order that allowed members of the Islamic Center of Murfreesboro to occupy their new structure.
The Appeals Courts heard litigation about the mosque on Tuesday. The question was raised, why is the case still before the courts if the mosque is built and in operation? It will take several months for the courts to release an opinion on the case.
