UPDATE: Suspect to Remain Behind Bars after Charges

A man indicted on three counts of aggravated robbery in Rutherford County in 2012 filed an appeal with the Court of Criminal Appeals in Nashville in hopes of getting his sentence reduced to spend less time behind bars.

Antonio Butler allegedly went into a home in LaVergne to allegedly buy drugs. In the process he and an accomplice allegedly displayed a weapon and robbed the reported drug dealer. Butler was later found guilty of aggravated assault and robbery in Judge David Bragg’s courtroom. He was sentenced to spend five years behind bars for each charge. Butler agreed to leave it to the trial court to determine the manner of service to which the sentences would be served.  

When the crime was committed, the suspect was said to be 17-years of age and admitted in court that he did have a past record. The courts apparently kept this in mind at the original sentencing. It was stated in the appeal paperwork released on Monday (4/15/13), “Confinement is necessary to protect society by restraining a defendant who has a long history of criminal conduct.” Judge Jeffery S. Bivens affirmed the decisions made by the trial courts and Butler will remain behind bars.
