Matthew B. Graham was sentenced in Rutherford County to 8-years in prison for the attempted abuse case and for three charges of possession of a controlled substance. Graham allegedly choked his former girlfriends’ 7-year old daughter in 2011.

According to court records, Graham received a suspended sentence for the crimes and was ordered to serve the sentence under supervised probation. While under probation, he apparently violated his sentence and was ordered to serve the remainder behind bars.

On Tuesday (July 30, 2013) the appeals court responded to a motion filed by Graham asking for the sentence to be modified and allow him to go back on supervised probation to avoid prison time. The court opinion filed by Senior Judge Paul G. Summers upheld the previous court’s decision and Graham will remain behind bars.
