Jurors found Rashii Brisbon guilty on aggravated child abuse in the death of 16-month old Kymari Clark. Judge Don Ash declared a mistrial on the charges of first degree murder when the jury was unable to reach a verdict after 10-hours of intense deliberation.
The 33-year old man was caring for the child in his South Church Street Murfreesboro home in June, 2010 when the child died. Local attorney Dicken Kidwell, representing the defense, argued the child had a seizure. Prosecutors had doctors testify that the child did not have a seizure, and died from being shaken. Brisbon did take the stand in his own defense and denied that he did anything to the child, who suffered from tuberous sclerosis.
Judge Don Ash will conduct a sentencing hearing for Rashii Brisbon in January. He could get up to 25-years on aggravated child abuse charges.
