Interim City Attorney, Adam Tucker submitted a staff recommendation to the council of an ordinance that would:
(1) implement a new state-mandated 1,500-foot distance requirement between an existing retail liquor store and a new retail liquor store;
(2) create a new on-premises retail beer permit specifically for the sale of beer on state-owned property, including Middle Tennessee State University; and
(3) correct inadvertently overbroad provisions of the previous Article V--regarding nudity and sexually explicit entertainment that, among other things, created ambiguity as to what type of conduct was permissible and could be construed as prohibiting mainstream movie theaters (theaters other than "adult-only theaters") and live-performance theaters, such as the Center for the Arts, from selling beer to patrons watching certain movies or
After several minutes of discussion, the amendments to the ordinance were passed with a majority vote noting that Councilmember, Bill Shacklett offered the descending vote.
