TN Supreme Court Halts Lortab Case from Moving Forward Again on Appeal

The Tennessee Supreme Court is not allowing an appeal to move forward in regards to a LaVergne Police drug arrest made outside of their jurisdiction, according to court documents. However, their was much more to the case.

Defendant Roy Allen Smith was convicted by a Rutherford County jury after at least 700 Lortab prescription pain pills were found behind his trailer. The pills were in coffee cans that matched one can that was inside the trailer and filled with change.

In a recent appeal, it was argued that Smith had ineffective assistance of counsel. But, the state disagreed...



The case was officially closed on October 10, 2018 and Smith will continue his twelve-year sentence, which was ordered to be served consecutively with six prior convictions for which the defendant had been on probation for when arrested by LaVergne Police and the TBI.
