It is a laundry list of charges that a man is asking for post conviction relief on in Rutherford County, according to a Court of Criminal Appeals filing on Monday, April 13, 2020.
Convicted felon Jonathan Alajemba petitioned the courts for relief from his convictions of:
1.) Facilitation of conspiracy to commit especially aggravated robbery
2.) Attempted especially aggravated robbery
4.) Aggravated assault
5.) Reckless aggravated assault
6.) Aggravated burglary
The petitioner was found guilty in a Rutherford County Courtroom under Judge David Bragg for crimes he committed in Murfreesboro in 2008. The man most recently alleged that his trial counsel was ineffective by persuading the Petitioner not to testify and failing to present proof of an insanity defense. Alajemba further alleged that newly discovered evidence in the form of recanted testimony established he did not intend to commit robbery.
Looking back, Alajemba and co-defendant's Coty Heath and Bobby Joel (B.J.) Wilson went to a home and attempted to rob a man named Tommy Moss, who was killed in the crime. Three other victims were also injured in the hold-up. One of the victims who survived testified, "You could tell that this was a massacre. And I did not know what was going on. It was just gun fire and screams."
According to court documents, Alajemba had intentions of robbing Moss of marijuana and cash that Moss had saved to spend on a music release or music promotion party.
The post-conviction court denied the petition, and the Petitioner appeals. The Court of Criminal Appeals are not allowing the case to go back to court and Alajemba will remain in the Hardemen County Correctional Facility. He will be 85 years old when he will first be eligible for release in year 2075.
