"Move Over" Law Is Serious!

In Tennessee there is a "Move Over" law that requires motorists to pull to the side of the roadway and stop to allow emergency vehicles to safely pass. Shortly after midnight, early Wednesday morning (5/30/2012), Officers Wilcox and Young were traveling along Barfield Crescent Road toward South Church Street. A fire truck with lights and siren on approached from the opposite direction and they pulled the police cruiser to the side of the roadway. However, the officers noticed that a silver BMW, traveling in the same direction as the fire truck did not pull over. In fact, the police report indicates that as the fire engine passed--the BMW sped up and passed the fire truck. 

When stopped, Robert Appleby allegedly told the police officers that he had been to a concert in Nashville and consumed a few beers and was simply in a hurry to get home.

The 48-year old Jenkins Road resident was issued his first DUI charge as well as being cited for violating the move over law. Field sobriety tests were made at the scene and blood was drawn at the Sheriff's Office for additional tests.

The University Medical Center employee was released on $1,750 bond. He asked that his son be given the vehicle to drive home. Robert Appleby's first court appearance is set for September 12th.
